These are the terms and conditions upon which each Entry to the CognitionX Awards (‘CXA’) shall be subject. If the CXA (“we”, “us”, “our”, or “CXA’s) accept an entrant’s (“you”, “your” or “entrant”) entry, you will be bound by these terms and conditions and your entry shall be considered and judged in accordance with these terms. We reserve the right to amend these terms and conditions at any time and such changes shall be deemed notified to you by their publication online.
The objective of the Awards is to achieve recognition for the achievements of the Award entrants and winners. By submitting an entry to the Awards you agree to participate in any reasonable PR activity related to the Awards.
Unless you check the box indicating that your application information is confidential, we may publish all or any part of the information contained in the Award application which you submit to us (‘Your Content’), at our sole discretion. We are not obliged to do so and we may not.
You retain any copyright you may have in Your Content. By submitting material to us, you grant us a royalty-free, perpetual, irrevocable, non-exclusive worldwide licence to use, copy, edit, adapt, publish, translate, create derivative works from, make available, communicate and distribute Your Content (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed. By submitting Your Content, you warrant that you have the right to grant this licence.
To the extent permitted by law, you waive your moral rights (e.g. the right to be identified as author or to object to derogatory treatment) in Your Content.
This means, for example (without limitation), that we can:
Remove Your Content, even if you have not breached these Terms
Use all or part of Your Content in promoting our products and services (e.g. we may use a screenshot including your comments in our advertising);
Edit your Content, which may result in a part of it being modified and displayed, including without your name.
The judges’ decisions are final and are not open to challenge.
All Entries must be submitted in the English language via the online entry form on the Website. Each Entry must be submitted to the CXA’s in accordance with these terms and conditions.
Each Entry must be completed in full and received by the CXA’s on or before the Closing Date. Entries received after the Closing Date maybe be disqualified. Entries which are not fully functional will be disqualified by the CXA’s at its sole discretion.
In the event that an Entry is inaccurate or incomplete, does not comply with these conditions for entry or is deemed, at the sole discretion of CXA’s, ineligible for any other reason, then the relevant Entry will be disqualified. For the avoidance of doubt the entry Fee is non-refundable except in the event that the Category of Award into which the Entry has been submitted is removed by us.
You may place your entry in more than one Category. You may enter multiple categories.
In the course of judging an Entry any judge may request further information about the Entry from the person named as the contact for the Entry submitted.
Judging will take place between the published dates.
Winners will be announced by the CXA’s at the Awards Event details of which will be published on the Site and such winners will be selected by the Judges.
Our decisions relating to granting of awards in the course of judging the CXA’s is final and we will not enter into any correspondence or discussion with any Entrants on any subject nor will we accept any submissions or representations or appeals with regard to such decisions, and CXA’s reserves at its sole discretion the right to:
Disqualify entries which do not comply with these conditions.
Remove categories without notice.
Move an entry to another Category without notice, if we feel it would be better suited in the relevant Category
CXA’s accepts no responsibility, financial or otherwise, for:
Any promise or indication made public before an Award is formally announced.
Any damage whatsoever caused by any actions taken by CXA’s in relation to any particular Entry.
In no event shall CXA’s be liable whether in contract, tort, by statute or otherwise in respect of any loss of profits and/or loss of business for any special, indirect, incidental or consequential loss or damage arising out of or in connection with the CXA’s, including without limitation: loss of revenue, loss of anticipated savings, loss of business and/or goods, loss of goodwill, loss of use, loss and/or corruption of data and/or other information.
Nothing in these terms and conditions shall exclude or restrict our liability for fraudulent misrepresentation and/or for death or personal injury to the extent that such injury results from our negligence or wilful default.
For the avoidance of doubt, entrants agree and accept that they will be solely responsible and liable for any and all damage caused by their Entry.
You will be informed whether your Entry has been shortlisted. The timescale shall be posted on the Website.
The following terms shall have the following meaning in these terms and conditions:‘Category’ means each particular category of award as more particularly listed and detailed on the Website.‘Closing Date’ 26th May 2016 ‘Entry’ means your entry submitted to the CXA’s on the site.‘Fee’ means the relevant entry fee corresponding to the relevant Entry according to the relevant Category for which the Entry is made as set out on the Website.‘Website’ or ‘the site’ means the CognitionX Awards web site.
